Terms of Service

These terms cover your use of Kaya's free wellness tools, including the Meal Plan app. Using them means you agree to these terms.

1. Who can use this

You must be 18 or older. You are responsible for your account and for the email address tied to your sign-in.

2. Not medical advice

THE MEAL PLAN APP AND EVERYTHING ELSE ON THIS SITE ARE FOR EDUCATION AND ORGANIZATION ONLY. THEY DO NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT, AND THEY ARE NOT A SUBSTITUTE FOR YOUR DOCTOR OR YOUR PROGRAM'S GUIDANCE. Always follow the instructions of your own healthcare provider, and talk to your provider before changing your diet, especially in a supervised weight-loss program. Kaya is not a medical provider.

3. No promises of results

We do not promise any particular health or weight outcome. Bodies differ, and results vary.

4. Your data

Your data is yours. You can export it or erase it as described in the Privacy Policy. Keep access to your sign-in email secure.

5. Acceptable use

Do not misuse the service: no scraping or automated access, no reverse engineering, no interfering with the service, no unlawful use, and no using it to harm others. One account per person.

6. Ownership

Kaya owns the app, its design, and its content. You keep the data you enter. We grant you a personal, non-transferable license to use the tool for your own wellness.

7. Availability

The service is free and provided as available. We may change or discontinue features at any time.

8. Disclaimer of warranties

THE SERVICE AND ALL INFORMATION IN IT, INCLUDING NUTRITION VALUES AND PLAN SUGGESTIONS, ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, INCLUDING ACCURACY, RELIABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT TEXAS LAW ALLOWS.

9. Limitation of liability

To the fullest extent Texas law allows, Kaya is not liable for indirect, incidental, or consequential damages arising from your use of the service, and our total liability is capped at the amount you paid us for it, which for the free tool is zero dollars. Nothing in these terms limits liability that Texas law does not allow us to limit.

10. Ending things

You can stop using the service at any time, and you can erase your data as described in the Privacy Policy. We may suspend accounts that violate these terms. The sections on ownership, disclaimers, liability, and governing law survive.

11. Governing law and disputes

Texas law governs these terms. If something goes wrong, email us first at shankar@mykayawellness.com and give us 30 days to make it right. If we cannot, disputes must be brought only in the state or federal courts located in Travis County, Texas, and both sides waive a jury trial.

12. Changes to these terms

We will post changes here with a new date. Continued use means acceptance.

13. The rest
